VOLUNTEER WAIVER AND RELEASE

FRIENDS OF WOODLAND PARK, INC. WOODLAND PARK IMPROVEMENT PROGRAM

This form must be signed by each volunteer who will participate (Participant) in or otherwise be involved in the Woodland Park Improvement Program (Program) which includes all efforts to clean or otherwise improve the park. Participants under age 18 must have this form signed by a parent or legal guardian. Parents/legal guardians are responsible for all decisions around supervising or delegating supervision of their minor children (for example, to a troop leader onsite). FWP Board members or FWP-designated event organizers may provide guidance but cannot and will not supervise participants, unless done so as part of another role (for example, as a parent or troop leader).

Sponsors will hereinafter include all, but not only, The City of Houston, Texas, The Houston Parks and Recreation Department, Harris County Flood Control District, Texas Department of Transportation, Friends of Woodland Park, Inc. and, if participating as part of an organized group, the group named below in the signature area.

In consideration of Participant being permitted to participate and as a condition to being allowed to participate in the Program, I, the undersigned, for and on behalf of myself, my minor child (if applicable), my heirs, executors, administrators and assigns, hereby release, acquit and forever discharge the Sponsors together with their former and present elected and appointed officials, directors, legal representatives, agents, servants, employees (in both their public and private capacities), volunteers, successors, assigns and all affiliated persons and entities (hereinafter collectively Sponsors), of, from and against any and all liabilities of every kind, claims, causes of action, whether at law or in equity, in contract or tort, under statutory or common law or pursuant to the Texas or United States Constitution(s) (including all expenses of litigation, cost, and attorneys’ fees), known or unknown, losses, judgments, fines, demands, damages, loss of use or services or injuries to real and/or personal property and/or persons (including death) (collectively “claims”), caused by, arising out of, touching upon or in any way relating to the Program and/or the presence, malfunction, maintenance, addition, substitution, use or condition of any tangible personal or real property owned, leased, operated, or utilized by the Sponsors in connection with the Program even if “claim” is the result of the actual or alleged sole negligence of the Sponsors and/or the actual or alleged joint or concurrent negligence of the Sponsors and any other person or entity, and/or the actual or alleged strict, statutory or constitutional liability of the Sponsors.

I further represent to the Sponsors that I am physically capable of participating in the Program and that to my knowledge I have no physical disabilities, impairments or health problems that would interfere with my ability to participate safely in this Program. Furthermore, I grant permission to photograph, record, broadcast and otherwise use in any media, including web pages or the internet, my or my child’s participation in the Program and to use my name, voice, and biographical information concerning me in connection therewith.
